Pursuant to Legal Notice 112 of 2025 dated 27th June 2025, marked the first official step in implementing the EU Pay Transparency Directive. Set to come into force on 27th August 2025, this new legislation brings with it tangible changes that affect both recruitment practices and the ongoing employment relationship.
From a recruitment perspective, employers are now required to inform job applicants, prior to the start of employment, of the initial salary or salary range for the position in question. Where applicable, any relevant provisions under collective agreements must also be communicated. This shift aims to establish greater openness from the outset, helping to prevent unjustified pay discrepancies and ensuring that expectations are clearly set at the earliest stage of the employment relationship.
Beyond recruitment, the Legal Notice grants employees the right to access comparative pay information during employment. At any time, employees may submit a written request to obtain details about their own remuneration as well as the pay levels of colleagues performing the same or equivalent work. Employers are obliged to respond to such requests within two months. As a result, this provision places a renewed emphasis on the need for well-structured, transparent internal pay systems. Employers must ensure that job classifications, salary records, and supporting documentation are clearly defined and consistently maintained.
